Overview

The city of Rehoboth Beach, Del. adopts and enforces the following codes:

• The International Building Code, 2012 edition. Rehoboth Beach, Del. Muni. Code § 102-1 (adopted) with Article II, §§ 102-2—102-9 (modifications).
• The International Residential Code, 2012 edition. Rehoboth Beach, Del. Muni. Code § 102-57 (adopted) with Article XVIII, §§ 102-58—102-67 (modifications).
• The International Existing Building Code, 2012 edition. Rehoboth Beach, Del. Muni. Code § 102-15 (adopted) with Article VII, §§ 102-16—102-18 (modifications).
• The International Energy Conservation Code, 2012 edition. Rehoboth Beach, Del. Muni. Code § 102-12 (adopted) with Article V, §§ 102-13—102-14 (modifications).
• The International Property Maintenance Code, 2012 edition. Rehoboth Beach, Del. Muni. Code § 102-44 (adopted) with Article XVI, §§ 102-45—102-56 (modifications).

Residential Building Code

Delaware has yet to adopt a statewide residential code. Local laws will control.See PLRB, Delaware Building Codes for more information on state level codes.

Rehoboth Beach adopted the 2012 IRC, locally. Note that adoptions usually come with amendments. So, it is important to review those amendments in addition to the unamended model code.

The city of Rehoboth Beach, Del. adopted the International Residential Code, 2012 edition, including appendix chapters A through K and M through Q. Rehoboth Beach, Del. Muni. Code § 102-57 (adopted) with Article XVIII, §§ 102-58—102-67 (modifications).

• Ice barrier is not required.

Rehoboth Beach, Del. Muni. Code § 102-63 (Table R301.2(1)).

 

Sections R313.1 through R313.2.1 of the Residential Code of the City of Rehoboth Beach be and the same is amended by deleting them in their entirety and inserting in lieu thereof a new Section R313.1 as follows:

R313.1 General. Dwelling unit fire sprinkler systems shall not be required per this Section R313 in the City of Rehoboth Beach, but if a dwelling unit fire sprinkler system is installed, said installation shall comply with the requirements of Section P2904 or NFPA 13D, as applicable. Rehoboth Beach, Del. Muni. Code § 102-65 (R313 amendments).

Existing Buildings

Existing buildings, meaning buildings that were built in accordance to code at the time of construction, typically merit extra consideration in a current updated code.

Appendix J of the 2012 IRC was adopted by the city.

Commercial Building Code

Rehoboth Beach adopted the 2012 IBC, locally . Note that adoptions usually come with amendments. So, it is important to review those amendments in addition to the unamended model code.

Section 3412.2 of the Building Code of the City of Rehoboth Beach be and the same is amended by striking the phrase “[DATE TO BE INSERTED BY THE JURISDICTION. NOTE: IT IS RECOMMENDED THAT THIS DATE COINCIDE WITH THE EFFECTIVE DATE OF BUILDING CODES WITHIN THE JURISDICTION]” as such phrase appears therein and inserting in lieu thereof the phrase “January 18, 2013.”
